  • Understanding Alberta’s 2025 Impaired Driving Reform

Impaired Driving Reform: What New Policing Rules Means for Drivers Effective March 10, 2025, drivers in Strathcona County, Alberta may face significant legal consequences if they are stopped for a traffic violation and are found to be impaired. Under newly expanded enforcement powers, Community Peace Officers (CPOs) now have the authority to request roadside breath samples during lawful traffic stops. This development is part of a broader shift in how Alberta handles impaired driving, driven by its focus on administrative rather than criminal penalties. While the Alberta Government ponders the creation of its own police force, over the last 18 months, municipalities such as Strathcona County have been increasingly employing sheriffs and peace officers to take over responsibilities once the exclusive domain of fully trained…

  • Future of the Law on Impaired Driving in Alberta

On June 4, the Alberta government announced that it intends to dramatically change the laws on impaired driving in Alberta. If passed, the new laws would take effect towards the end of this year. Many clients have been calling and wondering if the new law might affect their outstanding charges. It won’t. The new law will, however, have a dramatic effect on those stopped and investigated for impaired driving in the new year. There is much in the proposed legislation to make a defence lawyer shiver. Make no mistake! The presumption of innocence is under attack, as are the right to counsel and the right to make full answer and defense. Under the current legislation, an officer can randomly stop any vehicle he or she…

  • Miserable Holiday Haiku

Sleigh bells, egg nog andAn IRS for ChristmasFa law law Gunn Law The stress of the holidays ramps up exponentially if you get an impaired driving “charge” at the holidays. In Alberta, unless you have been stopped before for impaired driving or there was a bad accident, you likely will not be “charged” criminally if an officer believes you were driving while under the influence of alcohol  You may be breathing a sigh of relief, thinking, “The Christmas spirit is at work here”. Well, although the Christmas spirit is wandering around somewhere, it may have taken a bit of a detour at that moment. If the officer gives you an IRS (Immediate Roadside Sanction) also known as a Notice of Administrative Penalty (NAP) this is…

  • What My Husband Bought Me For Christmas

Christmas is over but some gifts keep on giving. Last Christmas, I asked my husband for an important gift. I wanted a dash cam for my vehicle. If you have listened to our podcast entitled, “Why SafeRoads Does Not Make Me Feel Safe,” you might be able to guess why. If a person is stopped by a police officer, especially if it is in RCMP territory, chances are that there is an audio and video recording going on the whole time. Many of our clients often express their desire to review the video evidence in their case, as they believe it could substantiate key aspects such as: instances of potential police misconduct, challenges in providing a breath sample, discrepancies between recorded results and officer reports,…

  • SafeRoads Alberta – Not a Simple System

If you were stopped for impaired driving, failing to provide a sample, or blowing over, you were likely given a Notice of Administrative Penalty. It’s also known as an N-A-P, also known as a NAP, also known as an Immediate Roadside Sanction, also known as an IRS… and the confusion doesn’t stop there. We’re here to give you tips and tricks for how to deal with this situation. Most importantly, do not pay the fine, if you pay the fine you will be cancelling any hearing that was already set up for you or it will preclude you from setting up the hearing. Don’t sit on it – you only have seven days to appeal! You can sometimes apply for an extension, but they’re not…

  • Outside the 7-day appeal for the impaired charge? Here is hope!

Getting stopped for a DUI never happens at a good moment. However, sometimes, it happens at a time when you just aren’t able to deal with it. Unfortunately, the IRS scheme waits for no one. If you got an Immediate Roadside Sanction for impaired driving (by alcohol or a drug), refusal, or failure to provide samples, you are expected to start your appeal within seven days. If you don’t, you will have to make an application to apply for late review. When the SafeRoads regime first came into being, my assumption was that those late reviews were going to be easy to get. It would enhance the look of fairness, apart from actually being fair. And I feel like that was the case, but then…

Moving back to Alberta, we needed to redo our wills. Having met Shannon through the process we were blown away! This would be the third time we’ve updated wills, etc. in our lifetime. Shannon and her team are the most thorough and compassionate lawyers we’ve ever had the privilege to deal with. Subsequent to that process we needed to refer a lawyer to a friend. Gunn law group was able to refer us to another specialized lawyer in Edmonton through their network. Keep up the great work Shannon & team, and say hi to your office’s pet turtle for us too.

Very Knowledgeable, Professional and Experienced, Appreciated their help navigating a complicated , government boondoggle , rigged bias system against the taxpayer , SafeRoads Alberta designed to collect revenue , support at any cost the RCMP officer who is now defacto Judge, Jury and Executioner on the roadside , and to infringe on the rights of the citizen. they have the tools to give the individual fair representation.

It took me a while to compile what to say in this review because I wanted to relay information not only to help people experiencing the same issue I did but to thank Shannon and Daryl from Gunn Law for doing an absolutely outstanding job representing me. #1 I googled DUI lawyers and the first one to come up were always the same-they told me the ONLY way to possibly win my case was GERD. #2 Always video anytime you get pulled over #3 Indicate medical issues with the officer including Migraine and GERD issues. #4 Daryl was instrumental in helping download videos from my iPhone to show the adjudicator #5 Shannon reviewed the entire episode of my being pulled over. Her investigation was very thorough and the 30 minutes that we deliberated my case with the adjudicator was excellent #6 The adjudicator agreed with Gunn law not only about the GERD issues, but the migraine issues and 7 other points that confirmed the cancellation of the charges Lucky #7 Is the point that do your due diligence and ask more than one lawyer about their view points and this way you make an informed decision. Thank you again Gunn Law!
